Intro: Brown & Williamson Tobacco Corporation said today that it has received a stay in a "lights" low tar class action, known as the Howard case, in Madison County, Illinois. The case is in the same jurisdiction in which the widely reported Price/Miles case resulted in a verdict against Philip Morris USA.
In response to Brown & Williamson's motion, the court stayed all further proceedings in the case. Brown & Williamson asked the court for the stay in light of the appeal filed by Philip Morris in the Price/Miles case, which raised similar legal issues.
Because various issues on appeal in the Miles case will impact directly the Howard case, the circuit court ruled that all proceedings, including discovery, would be stayed until further order of the court.

Intro: Brown & Williamson Tobacco Corp., the third-largest U.S. cigarette maker, said on Friday it got a stay in class action "lights" cigarettes case in the same Illinois jurisdiction where a judge found against rival Philip Morris USA in a similar suit earlier this year.
The court stayed all further proceedings in the Howard case because issues on appeal in the case against Philip Morris, known as Miles, would directly impact the case against Brown & Williamson, the Louisville, Kentucky-based company said.
