Intro: The 23-page ruling rejecting a motion from Philip Morris for dismissal was made on Aug. 13 by Judge David Folsom in U.S. District Court for the Eastern District of Texas. Folsom sent the opinion for immediate appeal to the Fifth Circuit and if the appellate court upholds it, a trial could begin next year.
Actor David McLean's widow, Lilo, and their son, Mark Huth, filed suit for wrongful death in 1996.
