Federal Court Rejects Minnesota Class Action / Philip Morris Says Decision Underlines Growing Trend 

In his decision, Judge Magnuson said plaintiffs' lawyers could not overcome their legal shortcomings by telling the court that a class action was the only way to proceed because of the inherent burden of the litigation.

``Although it is difficult to ignore this reality,'' Magnuson said, quoting an earlier case, ``it is not a sufficient reason to `headlong plunge into an unmanageable and interminable litigation process.'''
