VFW cited again for smoking

Veterans of Foreign Wars Post 1298, already contesting a previous citation it received for violating the city's ordinance against smoking, was cited for a second time Friday evening.

Passed in April by the Bowling Green Board of Commissioners as a way to address public health, the ordinance prohibits smoking in most public buildings within the city limits. Violators are subject to a $25 fine for a first offense and a fine of up to $50 for subsequent offenses.

The VFW and American Legion Post 23 claim that, as private organizations with exclusive memberships, they are exempt from the ordinance.

The city contends that both veterans organizations, which have been cited, fall under enforcement of the ordinance when the public attends their posts for charitable gaming events. But each post claims that those who attend those events are guests of VFW and Legion members.
